Legal Question in Family Law in Florida

My daughters father signed over power of attorney to his brothers mother, no relation to my daughter. She has been caring for my daughter since 2003 and from what I read power of attorney only lasts 6 months. what do I need to do to get my daughter back. The father is supposedly in georgia. I am in sarasota and daughter and guardian is in jacksonville. I had visitation rights and father nor guardian let me know that this occured. Father had interfered with my visitation by moving and not letting me know where he moved to. Finally found daughter when guardian came after me for child support. At that time in 2010 she still did not let me see my daughter. Not until June 2011 was I allowed to see my daugther when she tried filing for adoption and judge threw case out saying no grounds for adoption with no proof of abandonment.I want to file modification of custody to get custody back but how and to who? Father or custodian? Is there anything to file to get her sooner before school starts?

You need to consult with legal counsel. I and they need to review what ever orders you have from the court so they can probably advised you. A power of attorney does not trump your parental rights and you need to come to Jacksonville and pickup your child and filing the proper court motions. You can give me a call to discuss your options. 904-517-4584
