Extended Weekends

My court order states: ''The former husband shall be entitled to two (2) extended weekend visitation with the minor child per year to be chosen by the former husband with sufficient and reasonable notice to the former wife. One of the two extended weekends shall be the Teacher's Planning extended weekend in October as the minor child will always have that time off of school. The former husband will either travel to Florida or visit minor child or the minor child my travel to the State of Michigan. The second extended weekend shall be taken with the Former husband traveling to Florida. The extended weekend in Florida will consist of no less than (3) three nights and no more than 4 (4) nights and shall not interfere will Former Wife's holiday entitlements.'' Okay. . I am the former husband and I booked tickets for her to fly out on Thursday at 3:40pm and back on Sunday. . .I just found out that she now has school on that day (Thursday). . .Can I have the mother take her out of school for a half day or should I just send them on Friday. . . Legally what are my options? They have school on Thursday until 4:15pm and no school on that Friday.

Under Florida law you cannnot remove the child from school for anything other than an approved reason; trips/vacations are not approved reasons. The reality is the school will not care, in fact leaving early does not even count as an absence. Your real issue is whether your ex-wife will cooperate with you. Instead of "having the mother take her out" try ASKING the mother if she would PLEASE take her out early on Thursday. Otherwise, re-schedule.
