Legal Question in Family Law in Florida

False accusation of child sexual abuse

My 20-year old daughter has written a falsely- accusing and threatening letter to me saying that I touched her breasts in bed when she was a teenager and that she is going to report me. At first, I was livid with anger (she lives in Florida with her mother with whom I sadly have a very poor rapport) thinking this was another false story of victimhood; then I went into a state I can only describe as shock, then total upset, confusion and I am desperately trying to decide what to do but a MAJOR QUESTION is: what are the ramifications of such a report and what can I do? With whom might she file such a ''report''?

I have already written her a letter (not yet mailed) which goes from angry-confused to loving but I'm afraid of what she might be able to do to me and to my new marriage? My daughter lives in Florida and I live in Pennsylvania. Thank you so much for any help that you might give.

Re: False accusation of child sexual abuse

You asked about accusations of molestation.

You need to speak directly with a criminal attorney and a psychologist or psychiatrist about this issue. I'm not suggesting that there is an underlying perversity, but rather you need to understand how to deal with this issue. You correctly understood that your initial reaction may have been wrong. Don't respond to her letter until after you have obtained good advice from competent professionals.

At least at this point it is more of a personal issue than a legal issue. With proper counsel and advice you and your daughter can come through this. Also, you should discuss with those professionals about how to deal with discussing the issue with your new family. You won't be able to hide it and maybe you shouldn't try to do so.

Regards,

Roger
