Legal Question in Family Law in Florida

I'm the father of my 4yr old daughter and I am very concerned that my wife who is currently in a Rehab facility and getting out 6-8 months from now is going to move in with my daughter.Right now she is in my custody but the case has not went to the courts yet. I am going to file for Full Custody and a Dissolution of Marriage. There have been numerous times she has been in the hospital for drug abuse and mental abuse.I DO NOT WANT MY DAUGHTER LIVING WITH MY WIFE In my honest opinion, she can not take care of herself, how is she going to care for our 4yr old daughter?

My question is what would be the proper procedure in order to prevent this from happening?

Thanks Alot

A Very Concerned Dad

You should begin with the Dissolution of Marriage and ask for full custody of the child. You may want to go a step further and petition for the mother to have supervised visitation. For assistance, please contact my office at 904-371-3538 or email me at [email protected].

The most cost efficient way of doing this would be to pursue a divorce. This would avoid much duplication of effort, and attorney fees. You can seek sole parental custody through the divorce proceeding.

If you opt to proceed without the assistance of counsel, be aware that you will not be entitled to a do over if things go badly.

An internet inquiry is no substitution for an in-office consultation with an attorney.

If your situation falls within the Greater Tampa Bay area, I would be happy to schedule you for a no obligation half hour office consultation. The main office is in Dunedin, with a satellite location in Tampa.

Feel free to Google me.

My colleagues have given you excellent advice. You should obtain an attorney to do this as when it comes to children, pro se is really not the route to go as there are no "do overs" if you fail to file the correct pleading or plead the case as needed.

contact my office if you are in my area for an appointment.
