If you are not married, the mother of the child is considered to have sole custody of the child. You will want to file a Petition to Determine Paternity as soon as possible so that you can establish your parental rights through the court. Until you do that, she does have the right to remove the child from the state.

If you are not married to her then she can do what she wants until such time when you got to court to enforce your rights. So you need to retain a lawyer sasp. Contact my office for free consultation 727-446-7659.
