Legal Question in Family Law in Florida

My husband is filing for divorce in Florida. He has listed my hearing aids as marital property. Is this legal? How do we "value" jewelery? I can't get Tiffany prices on E-bay. Is re-sale price the correct price or do I have to go by a much higher replacement price?

Did you say he listed your hearing aid as marital property? As for jewelry you would go with the appraisal value. You can have the jewelry appraised and submit that to the court as evidence of it's current value. As for your hearing aid's not sure who advised him to list that as marital property. If you have any further questions you should contact legal counsel as it sounds like you have a legal battle brewing.

All items should be valued at their fair market value. If the valuations are contested, you might need testimony from an expert.

While technically, your hearing aid probably is marital property, his insistence on categorizing it as such will likely turn-off the judge. When you go to court, he might as well wear a sign saying "I AM A JERK".

If either of the parties, or both: have significant assets and/or debts; own any real property; have any minor children, or disabled adult children, then you probably should retain legal counsel.

Are you seeking alimony. If so, how long have you been married?
