Legal Question in Family Law in Florida

Legal rights on child support

I am ordered by the courts to pay child support. However, my ex-wife is not allowing me to have the children over my house for visitation. She is remarried and is telling me I am responsible for medical insurance. I am wondering if I am responisble for the childrens medical and if I have legal rights for visitation.

Re: Legal rights on child support

If a visitation schedule has not been drafted then you need to have this taken care of. This should be done at the same time the child support is calculated. You can file a motion with the court requesting schedule at which time you would be ordered to mediation and the mediator along with you and your ex will draft a schedule. If your ex is not allowing visitation then she is in contempt. She can not deny visitation unless the court has ordered that you are not permitted visitation. Medical insurance is usually split between the parties according to their percentage share of child support. That should have been included in the order of child support. Feel free to contact me.
