Legal Question in Family Law in Florida

Hi, I have a question...last Wednesday (Sep 30th), I had a child support hearing for extension of my child support and to make a long story short...the judge denied the request because Child Support Enforcement Agency here in Florida filed the paperwork late. I turned in my paperwork at the beginning of 2009 stating that my son will still be a senior when he turns 18 because of how his birthday falls. They filed the request for extension in February 2010 and my son had turned 18 in November of 2009. I missed work on that day and because the paperwork was filed late, the judge could not grant me the extension. Also, my son's father is $16,300 in the arrearage. My question is...is there anything I can do to put in a complaint with the Child Support Enforcement Agency here in Florida? Also, how can I re-coup that back money that is owed to me? Is there a way that I can sue for that arrearage amount without going through Florida Child Support Enforcement Agency? They are already swamped with cases that's why my child support got so behind. By the way, my son's father resides in the state of Tennessee and he is currently employed. Thank you, Rosella

You really need to file with the Florida Child Support Enforcement Agency - since you have an address of where he works, it should not be hard for them to garnish his wages with an Order for Income Deduction. Otherwise, you could request an Order for Income Deduction from the general magistrate in the county you are dealing with. It must be specific to show arrearage and the amount due.
