Retainer Fee Refund?

I paid an attorney $3000.00 to prepare an Agreement and Divorce. I met with him twice and subsequently changed my mind and decided to work it out with my husband. I requested the remaining funds of $900.00 to be refunded to me. To date, the attorney has not given me the copies of the documents I was charged for him preparing. He is not returning my faxes or calls. I sent a letter requesting the remaining funds in trust be refunded. Does he have the right to keep my money although I have nothing to show for the money I spent? Please advise.

It depends. Did you sign an agreement with the attorney saying your payment to him was nonrefundable? Did you sign anything with him? Was the agreement a flat fee agreement? Did the attorney say he would be placing the funds in a trust account, or are you just assuming it? Has the attorney told you why he won't return the funds? Have you written the attorney specifically to ask why he won't return the $900? Have you written to him to ask for a statement of your bill or your funds in trust?
