Legal Question in Family Law in Florida

My son took his fathers name on the birth certificate we were never married i married another man and we have had no contact with my sons boligical father in almost four years we are now in the military and i cannot take my son what should i do where i know he wont get custody after three years of avandoment

You can name a child anything you want. If you were never married he has no rights unless he pursues them.
