Summer child support

Question?

If my x husband who lives in Florida and pays child support, has our daughter for a month in the summer, will I still recieve child support, or does he have the right to keep the support because she will be with him during that time.

You should refer to the Child Support Order or the Judgment of Divorce. If the order does not provide for an abatement of child support during the vacation, then there is no abatement.

We sometimes include such clauses in agreements, when the child is away at college, and then the abatement is only partial.

Suggest you consult with an experienced matrimonial attorney.

Re: Summer child support

You are each required to abide by the terms of the Final Judgment. No reductions to support may be made without consent of the other party. I do suggest that if you insist on full support, that you provide adequate clothing, shoes and personal items purchased with that support. If your child is older, a cash allowance would be fair.
