County Tortious Action

My wife was bitten by one of 2 dogs while breaking up a dog fight. One dog was watched by Animal Control and certified as healthy from rabies. The second dog was cremated by the owner. Animal Control was aprised of the bite BEFORE the animal was cremated. My wife was advised that there is a small chance that she could contract rabies. Contracting rabies is fatal there is NO cure. She is undergoing rabies treatment and has been put under a great deal of emotional stress. She is having difficulty performing her job as she is worried about catching rabies. What recourse do we have against the county for their apparent neglect in investigating a communicable disease problem. Animal Control stated that they decided which dog did the biting, and they stated that they decided there was not a problem.

Do we have legal recourse against the county. If so, what can we do?

You can seek compensation for the physical injury and reasonable emotional fear of rabies.

Call the county. I am sure they have a requirement that a notice of claim be filed with them within a certain period of time after the accident. A question she wil have to answer is why she put herself into a position of being bitten.
