Legal Question in Civil Litigation in Florida

deprivation of character

My husband is an adminastrator in the public school system and a student has slandered his name by creating a My Space page which identifies him as a child rapist and more. What legal action can be taken?

Re: deprivation of character

(This is not legal advise)

Initially, you should file an action seeking an injunction against the student. Essentially this just asks the court to enter an order demanding that the student remove the offensive content and not to redeploy the offensive content.

You may also have an action for damages in tort law based upon this student's conduct if you can show that your husband has suffered some identifiable damage.

You may want to consider filing a lawsuit to obtain injunctive relief and/or damages, if available. You should consider consulting an attorney to assess what legal remedies may be available.
