Legal Question in Civil Litigation in Florida

Parner owes me money back on Investment check

I made an investment with a partner on 9 houses for about $26,000.00 in my investment capital. Gave him this money 3 years ago and he sold the last house over a year ago .... still has not returned my investment! ( I have a copy of the check and a simple contract that says he will pay me 25% of the profits on these deals)

How so I force him to pay me back my investment?

NOTE: This communication is not intended as and should not be interpreted as legal advice. Rather, it is intended solely as a general discussion of legal principles. You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. By reading the "Response" to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.

You did not mention whether or not there was a written agreement. If so, it should set forth how and when you are to be repaid and given your profits. If all the houses were sold over a year ago, it sounds as if that time should have already come. If your "partner" refuses to pay you your share, then you will need to take him or her to court immediately although it may even be too late if all the monies have disappeared.
