Jurisdiction for Small Claims

Money was borrowed ($3,000) to a person who resided in South Carolina to help in his move to Utah. He now resides and works in Utah and we live in Florida. Is jurisdiction in Utah?

Utah definitely has jurisdiction. Florida may have jurisdiction depending on the terms of your loan agreement. Suing in Utah for $3,000 can be a pain, so you may want to try here first yourself in small claims court.

The defendant resides in Utah so personal jurisdiction is in that state. The cause of action most likely arose in Utah also because that is where he defaulted on the promissory note. That is called the subject matter jurisdiction. Therefore, I would definately sue in Utah. I recommend contacting a Utah attorney in the city which the Defendant resides to represent you. Good luck!
