Legal Question in Civil Litigation in Florida

I purchased an aquarium chiller off craigslist, from a guy named Dave... met the guy in Eustis, Florida (1-1/2 hour drive one way) at a store.

He assured me it was in new condition and worked perfectly.

Once I returned home, I plugged it in and nothing. the thing is completely in unworking condition.

I called Dave and left him a message.

He returned my call in 20 minutes, apologizing, and promising a refund.

Since then, I have called him, texted, and emailed many times.

He responded to a few in the beginning. but the last two weeks he has started ignoring me and obviously he is refusing to pay.

Were not talking about a huge amount of money, but it is $325 and it is the principle of people ripping other off without a care in the world.

I have all the records of our conversing with him recognizing it doesnt work and promising a refund.

clearly he knew it was broke when I bought it.

So of course I must sue him to get my money returned plus time and expenses.

You sue In Small claims court where he lives. Did you buy it from him or the store?
