Legal Question in Civil Litigation in Florida

Out of State Garnishment

We live in Michigan. We won a small claims judgement on a firm doing business in Florida.

Now I have the defendents Federal Tax ID no. I need to file a Garnishment using the FEI on the company in Florida. The judgment was awarded by 52/3 district court in Oakland, MI.

Please tell me how can I proceed on the above.

It's a lot more complicated than you think. You have to take the Michigan judgment and start suit in the local court in Florida, stating that the Florida Court has the duty to enter judgment based upon the Michigan judgment. Then, once you get a judgment in Florida, you can then execute using the Florida rules. The Florida sheriffs will not execute upon a Michigan judgment without also obtaining the judgment in Florida. You'll need to domesticate the Michigan judgmnet in Florida before you can attempt a garnishment action (the FEI number is irrelevant). I invite you to contact my office.
