Legal Question in Civil Litigation in Florida

I am being sued and the other party's lawyer has asked the judge for a constructive trust placed on my property. I have gone to mediation, but to no avail. This person wants either my home or a lot of money. Since I knew I was getting ready to be sued, I changed the title over to my brother's name to protect my assets. Can a judge really award my home to this person? Make me sell to award this person the money they want from me that I can not give?

No. In Florida your homestead is protected from those you may owe money to. Changing title to other property may be considered fraudulent though and may be reversed by a court that finds against you. If you would like to consult further on the matter, call my law office at (813) 951-6187.
