Legal Question in Immigration Law in Florida

Hi,

I APPLIED FOR CITIZENSHIP IN JANUARY OF THIS YEAR, AFTER BEING HERE CONTINUOUSLY FOR 26 MONTHS(BEFORE THAT I DID SOME TRAVELING TO EUROPE) BUT ALL TOGETHER I HAD MORE THAN 30 MONTHS IN USA. THEY DENIED MY APPLICATION DUE TO LACK OF CONTINUITY OF TIME IN USA. IN THE PROCESS I HAVE BEEN HERE FOR MORE THAN 30 MONTHS. THEY ARE GIVING ME A CHANCE TO APPEAL FOR A FEE OF 605$ AS THE LETTER I WROTE TO THEM WASN'T SUFFICIENT TO PROVE MY ELIGIBILITY FOR CITIZENSHIP. IS THERE ANYTHING THAT CAN BE DONE OR I SHOULD JUST RE APPLY AND START THE PROCESS AGAIN, IF SO WHEN IS THE GOOD/PROVABLE TIME AS THEY DIDN'T STATE ANY DATE IN THEIR DENIAL LETTER.

PLEASE ADVISE.

AGNES

Agnes,

You should consult an immigration attorney. An attorney should review your immigration history and all trips abroad. Of course, the USCIS is not going to provide you a legal advice as to when you shall apply for naturalization. Whenever you apply for naturalization, it's your burden to prove your eligibility to the USCIS.

If you would like to schedule a telephone consult, please email.
