Legal Question in Insurance Law in Florida

Auto accident--no insurance--do I have to pay?

I was in a parking lot and me and another lady started backing out at the same time and had slight rear end collision. My insurance had been cancelled. There was a witness saying we both began pulling out at same time but her insurance company is saying I owe them 954.36 for damages. Do I have to pay this? Should she be responsible for her damages and me for my own? No one was cited at fault. Thanks.

In Fla. comparative negligence or fault applies. In other words each party can be at fault 50/50, 90/10, 75/25% etc. Thus if you and the other driver were each 50% at fault you would only owe 50% of the damages.
