Legal Question in Insurance Law in Florida

stolen car rental - lawsuit

I rented a car two years ago (planned to have it long term) and it was stolen while I was in Europe. I didn't file a report, I thought my insurance company did. The other party is claiming injuries, we are not aware as to what extent, but my ins. agent thinks they are minor. They filed a lawsuit against me. And I am expected to attend a deposition. I do not wish to attend that. The person I think may have done this caused many emotional scars I don't want to ever think about again. I would rather pay this other person's injuries out of pocket, if they are not over 10-15 grand, then go through this type of thing. I want this to be done, and don't care about the money involved. What are the consequenecs of not attending a deposition? Could I get out of it in exchange for paying this myself and not getting my insurance involved?

Re: stolen car rental - lawsuit

Go see a lawyer.

The insurance company should have provided one for you.

Depositions are nothing to be afraid of. It is unlikely that you can avoid it, but it is possible if you or the carrier is willing to pay. If you have insurance, it is foolish for you to pay for what you paid for (coverage).

You say the car is stolen, bbut that you know who did this. That really does not make sense and I guess that is somehow connected with the emotional scars that you reference. Nonetheless -- go see your lawyer and discuss this fully.
