Legal Question in Intellectual Property in Florida

''Dead'' Trademark Rights

I want to file a trademark name... I did search... Found name already used but was considered ''Dead'' not ''Live''. This trademark name is under the same category class 025 clothing, I want to file. If it's considered dead may I file for same name under same class?

You may apply, but the reason for the death may be fatal to your application also.
