Legal Question in Employment Law in Florida

What can I do about a employer not paying me my last two paychecks?I was 1099ed so I guess he thinks I cant prove it.I have dates I worked and homeowners that knew I worked on those dates, but no pay for them.He payed with company checks on previous jobs so those should be able to be tracked up to the last time he paid then I can prove where pay stopped but work continued. What can I do to get my pay?

You can sue in small claims court for a value of up to $5,000. It is hard to prove a negative (you didn't get paid), but if you can make a basic case, he will have to defend by proving he did pay you. See the FL Small Claims court rules for info on how to gather discovery in small claims (rules are available at www.flabar.org).
