Legal Question in Employment Law in Florida

non compete laws

My company recently went out of business. I am a mortgage loan officer, I went to a interview today with another loan company, they told me I have to sign a 2 year nocompete contract. I can not within this time period apply for a mortgage license or work for any mortgage company in the state of Florida. Even if I were to be terminated from this company, they told me it was still enforcable. I thought there was a ''Right to work'' law that protects me.

Re: non compete laws

Florida is an "employment at will State," which means you are generally free to end your employment, as is your employer, for any reason at any time.

"Right to work" refers to union jobs, and means that in Florida you cannot be required to join a union to be employed at a place that has a union.

Whether the non-compete they are asking you to sign is enforceable is a fact specific question, so you should consult with an attorney to determine what your rights are and whether the proposed Agreement is supported by a "legitimate business interest." Please feel free to contact us for further assistance if you should need to do so.
