Signing a release to be paid vacation pay

My company is selling a majority of its assets to another company. In order for employees to get paid their earned vacation time, they are requiring employees sign a release. The vacation policy allows for cashing out some hours and carrying over some hours. They are also not putting in the over 40 language for review time and revocation in the release. Can they legally hold the vacation pay in return for the release?

Vacation pay is not a requirement. However, before you sign a release you should have an attorney look at it. If you are giving up rights to sue for overtime pay, discrimination, harassment, etc. you need to make sure you don't feel you have any claims which are valid before you sign a release.
