Legal Question in Landlord & Tenant Law in Florida

My rent is due on the 13 of each month, i paid my dec rent on time and have the money orders to prove it. My landloard says that i have to move because the father of my son is a felon and can not be on the property at any time to visit due to the fact that it says that in the association rules.He now wants to show the town house and me and my kids are still liveing here and my rent is not behind at all. Does he have to right to evict me in such short notice and show the house with me and my kids still here. please help.. do i have any rights

Your rights are governed by the terms and conditions of your lease and your lease application. You must have been given a copy of the association rules, before you moved in. If your lease application or the association rules stated that no felons could visit the property, then you were given notice of this restriction. If your lease states that the landlord has the right to show the property, while you are still in residence, then he has the right to show the property. You need to READ your lease and your lease application. If you don't understand what it says, take it to the nearest legal aid clinic and ask an attorney to read it for you, and explain the terms to you.

Although I agree with Ms. Schellenberg, please note that your lease probably states that if you are a felon you may not live on the property. Since this is a visitation situation, State and Federal laws will overrule any HO policy as it would be considered unconstitutional under Florida's constitution and under the Supreme Court.

Please take this lease to a legal aid clinic or ask an attorney in your area. Most attorneys will not charge for a consultation.
