how can i sue for my deposit and what should i present in court if needed to go that route.

You need to have a copy of your lease. Also a copy of your canceled check if you have one. You need the name and address of the landlord. You can file in small claims court, or you can have an attorney file for you. If your deposit is a large deposit, (more than $1000), you may want to hire an attorney, as you may be entitled to legal fees, depending on the facts of your case, and whether or not your landlord violated state laws.
