Dr. misdiagnosed melanoma as mole for 2 years

My husband's Dr for his hypertension is also supposed to be a skin Dr. He had him look at a suspicious place on his leg, and Dr. told him it was a birthmark. That was 2 yrs ago. My husband again had Dr. look at it, as it had changed, a year ago. Dr. again told him it was a birthmark. Dr. had treated other skin lesions that turned out to be basal cell carcinoma, but never biopsied suspected spot. My husband was sent to a dermatologist to schedule removal of basal cell area, and Dr. saw the spot on his leg and immediately biopsied it, and sent him to surgeon. I have a copy of all medical records from first Dr, but cannot find references of this spot, but cannot read all writing. This is also the same Dr. that gave my husband Baycol and almost killed him. Dr. never called us to warn us when it was found out to be fatal in some cases. My husband took it one time and got extremely sick. He never took it again, and later that week via newspaper, found out about how dangerous baycol was. Dr. never mentioned it to us. DO we have a case against this Dr?
