Fingerprinting and Court-Martials and Future Employment
I was courtmarital in 2001 and Fingerprinted. My charge was Article 92 Failure to Disobey an order and Obstruction of Justice charge. Basically nothing that could get my arrested outside the military. I had a inappropriate realtionship with a lower ranking person. I received 3 years and did a year and half at Miramar Brig in SD, CA. I am now currently going to be working with a union for schools in the state of FL---I have no idea if they will fingerprint me so this might be a mute point. My ? is if they do (because I go into schools to see teachers and there is a new FL state law that everyone who comes in contact with children have to be fingerprinted) will it come up and if it does on the fingerprinting---what will it say? They know nothing----would love some help with it. Some say I am a felon (the military) but I voted in the presential election and noone stopped me and my husband has a gun in both of our names for protection. I know that if you are a felon you cannot do either things. So will it show up on a Federal Identification Record or Rap sheet from the FBI and what exactly would it say? Thanks in advance for any help that someone can assist me with in this situation. Thank you.

Not sure. It's purely a question of FL law. Best to consult a FL criminal defense attorney. If you are fingerprinted, and if they check it against nationwide law enforcement records, your conviction will turn up, which you then may have to simply explain to your potential employers. Full disclosure and complete honesty is the best course of action. It may be a non-issue, but be aware that obstruction of justice is a very serious military AND civilian criminal offense. It directly reflects on your honesty and integrity, and could cause an employer to decline to hire you.
