Legal Question in Personal Injury in Florida

In 2006 my son was attacked by another inmate, hit with a combination lock inside of a sock, all the bones in his hand was broken, the prison gave no medical treatment of 2 days. Now he is injuried for life. Can the Fl State Prison be suited?

Probably not at this point. To sue a governmental entity you must provide formal notice to them within 3 years of the incident. It looks like thattime has passed for a claim under the sovereign immunity statute. You also would face the problem of proving that the delay -- as opposed to the initial injury -- caused the problems he now deals with. Tough case even if it could be brought. Consult directly with a lawyer to explore all of the facts, though, if he wants to pursue this.
