Legal Question in Personal Injury in Florida

Hi I was in a automobil accident in Jan.2010 with a pedestrian(a 12yr old boy) with asperger's autism it is a disorder in which a child doesnt do well in socia situations. The boy was by himself and the car on the other side of the street waved him across he took off running and ran right in front/into my car he caused quit a bit of damage to my car over $3,000. He and his mother hired a lawyer and sued my insurance for $10,000 which they got. it was documented that I was not at fault I want the $657.57 that I had to pay for deductible and rental car due to this accident. I want to take the childs mother to small claims court for neglect and prove that she is responible for these charges but I spoke to a police officer that told me to sue my insurance company for the damages but if I sue the insurance company will I have to get a lawyer please assist me in the best way to get the money for the damages for an accident that clearly was not my fault?????
