I got into a car accident but the other driver was at fault. she said she would pay for all my damages because she dont want to got thru the insurance company . i got her on video saying she would pay for all damages and i also got a written statement from her. i got all her information. i want to know do i have a case

Well that is a good question. Most attorneys would recommend that you still file a claim with her car insurance policy as you may have an uphill battle trying to collect from her even though she has agreed verbally and in writing.

You certainly have a good start with her admission against interest. However, I would caution you to avoid doing things outside of the insurance company umbrella. That's what insurance is for. These private agreements can be difficult to enforce in the end, and you may be left stuck holding the bill. Either way, it's always a good idea to consult with a professional.

The other two answers are spot on. You have a good start with an admission by a party that she was at fault. However, insurance is there for a reason. Having someone say they are going to pay is like having a judgment against somebody. It may not be worth the paper it's printed on. However, the insurance company is a source of funds and should be utilized. An experienced professional in this area should be consulted. Good luck.
