Legal Question in Personal Injury in Florida

my daughters ages 21 & 13 were in a car accident. My 21 year old was driving my ex-husbands car which she is under his car insurance. Both were hurt and he is suing. He says all the money will go to him in his name and he will decide what to do with it. Is this how it works. Wouldn't the money go to my 21 year old and in trust for my 13 year old so no one can touch it but them. I understand the check for the car would go to him but that should be it.

Your 21 year old has the right to bring a lawsuit for her injuries on her own. If she is successful proving that someone else was responsible the money that she recovers would be hers. As to your 13 year old, you are correct that her money would have to be in a guardianship controlled by the court and expenditures would only be for her benefit.
