Legal Question in Personal Injury in Florida

Possible lawsuit due to auto accident

I was recently in an auto accident where the person in my vehicle was injured. I was charged with the accident and the person in my vehicle has obtained an attorney. My auto insurance will offer them a settlement, however if he does not accept this what would my options be? I have no assets, no car, no home. If a judgement is passed on me would bankrupcy be an option?

Suggest you retain a private attorney to protect you over and above your policy limits.

You may be overreacting. First you may want to discuss the seriousness of the injuries in relationship to your insurance policy limits. Ordinarily attorneys do not want to chase people above policy limits because of the difficulty of collecting and the bankruptcy option. You have the right to see the insurance company claim file to assist you and may want to discuss first with the attorney assigned by the insurance company to defend the case. You can then decide if you need your own personal attorney to help you.
