Legal Question in Personal Injury in Florida

if you get a nolle prosqui can someone still try to pinn the crime on you
my girlfriend and her friend let someone drive them home in her friends truck from the club they were at. she was in the middle her friend was in the passenger side the guy hit a tree and ran. my girl friend was accused of driveing she got 2 tickets luckey enough the state found the whitness the chages were dropped.the whitness saw the guy run from the truck. her friend wants to go to small claims court they dont even have the drivers name or no were he lives this happend 1yr ago i think the friend is trying to blame her what sould she do.
