Where does the requirement for a permanent impairment come from, statute or case law?

If you are referring to the serious injury requirement to make a claim for injury in a motor vehicle accident it is statute law. Most states now have some type of similar law.

If you are referring to injuries from a car accident, it is by statute. Permanent impairment is not always required for injuries not caused by a car accident.
