settling auto accident with ins co myself

I was visiting in Miami to attend a wedding when we were rearended on the interstate when traffic came to a stop. I was rushed to the hospital in an ambulance because of high blood pressure and some chest pain. I was admitted and released the next night despite the physicians requesting that I stay. I was there to attend a wedding that I missed because of the hospital stay. I returned to SC and hired an attorney who was subsequently placed on incapacitated status and he moved away. When I received my file there was nothing done regarding the accident. I am now attempting to negotiate with the ins co myself. What do I need to consider before accepting an offer. Should I be reimbursed for missing the wedding which was my intended reason for being there? The drive to Miami was 13 hrs there and 18 hrs back because of my discomfort. Also 30 days later I was admitted to the hospital here at home again for my leg but was dx with some condition related to my blood pressure instead. I have presented the ins co with these bills also. What can I expect to happen with these bills? I have read the FAQs and didnt see anything related to this situation

Can you imagine asking a doctor to advise you on how you can perform a medical procedure? Seriously, I would love to give you some help but am afraid that I would be doing you a dis-service unless I had the file, saw the medical reports, reviewed the police/accident report, etc., etc. There are a lot of legal considerations that go into these matters and it would just be irresponsible for an attorney to try and give you advise and take the chance that something is being overlooked. However, as couresy, if you would like to call I would be happy to answer any questions you have. Or, better yet, you should go visit an attorney near you and let him/her review the matter to see that what ever direction and advice your given is the best for your particular situation.

There are hundreds of factors to be considered when settling with the insurance company and I don't think any attorney can post a response without fully investigating the facts of your case. The insurance company often tries to settle for as little as possible. You probably should have an attorney review the file to give you the best advice and fight to get you as much as possible. Most accident attorneys work on a contingency fee, so you wouldn't have to pay anything out of pocket for them to handle the claim.

I agree with the other lawyers, there are issues as to what your claimed injuries are plus there are logistic issues about how much insurance is involved and by whom and other factors.

If you have been given an offer, there are many lawyers that will only charge a fee on an offer above the amount you were offered. However, i would recommned you seek counsel before that as you may make it more difficult to receive a voluntary settlement.
