Binding Arbitration

Can a builder leagally refuse to sell a home if the buyer rejects the home warranty b/c it includes a ''binding arbitration clause''? It seems that builders frequently force buyers into agreeing to this as term of the contract. Is that legal? I don't want to give up my right to court b/c a builder wants to limit his liability.
