You need a probate attorney. His wife at the time of the death, if no will, was entitled to a life estate with the remainder to all living children. You would be entitled to your share. you would be entitled to credit for the sums you expended for the maintenance of the home and you would be responsible for the reasonable rental value of the home as well. She likely does not have a fee simple title which allows her to sell the home, BUT that is a guess based on the above facts. Seek legal help.
