Rental Deposit Refund?

I recently gave $1200 to a landlord for a 1st and last months rent. three days later a realized I was unable to be in this house so I have requested $800 of that deposit back (I offered to pay $400 for the contract o be drawn up). Am I legally entitled to the refund?
