Re: re-course of action

Actually your question does not deal with sexual harassment law but instead tort law, since you ask what are your remedies as the accused person.

Therefore, you should consult with a tort or personal injury lawyer to ask about remedies for slander or defamation or interference with contractual relationship. However, I can offer the following informal hint, while urging you to contact local tort law counsel: Usually a person has a qualified privilege to file charges against another, but if the charges are filed in blatant bad faith, and as an abuse of process, civil or criminal, the accused person, in some instances may be able to assert a civil claim for abuse of process. another problem with your scenario is that the accuser is mentally ill... will your employer take the accusatioins seriously? Find out if the accuser has made other accusations of this kind. Assert the procedureal rights given you by your employer's disciplinary policies of rules. Since your job is at stake, you would be well advised to see legal counsel.
