Legal Question in Traffic Law in Florida

school zone posting times

If the times posted on the school zone sign does not meet the times that Fl statue 316.1895 state that school speed limits apply can you still be quilty of speeding. I got a ticket at 3:40 and the statue says that it should not be until 30 minutes before dismissal of school and school doesn't get out until 4:15 so the sign posted has the wrong times on it.

Re: school zone posting times

Hello. I just reviewed your question. You may have a good argument. I have not reviewed the statute. Was the light flashing in the school zone? If not, that is more evidence you could provide the court.

If you want a hearing on your ticket, you need to elect that option by properly notifying the clerk of court-trafic dept. in the county where you got the ticket. Keep in mind, some hearing officers/judges take a hard stance on school zone speeding citations. You may want to ask the court if he/she would withold the points if you plead to the ticket, and reduce the costs to the minimum...as a compromise. 'Hope this helps. Tom Rosenblum
