Legal Question in Traffic Law in Florida

suspended licence

Hi, my roommate just got pulled over and he has a suspended license. The reason why is he failed to show proof of insurance. He had insurance at the time but he didnt have the insurance card and after that, he left the country for a few months so he never had a chance to show proof of insurance. What can he do to clear his name? The officer gave him a court date but he wants to clear it before then. Also, the officer took his plate and his Puerto Rico driver license not this Florida driver license. His PR DL is fine, its his FL DL that was suspended. Can the officer do that?

Thanks for the help!

You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. If you do not agree, then stop right here, and do not read any further.

First, your roommate will have to deal with this himself. You cannot represent him in this matter. Only an attorney can act for another in a legal matter under Florida law. He can show his proof of insurance probably get the matter dismissed by paying a small fee for court costs or a fine but not receiving any points or mark against his record. He can go to court on the date it is scheduled or to the "walk in court" on any date he chooses. He can also hire an attorney who can take care of this for him. As to the suspended license, you were not clear on the facts.
