Legal Question in Wills and Trusts in Florida
Name change and titling of deed and accounts
Hello,
Home is titled as life estate. Other accounts are titled as TOD/POD. If the person with remainder interest and beneficiery of the TOD/POD accounts changes her name, do the titles of the accounts need to be changed to reflect the new name or would documentation of legal name change be adequate if and when the time comes for transfer of property and other accounts?
Thanks.

A certified copy of the documentation should be sufficeint. Good luck.

Putting the new name on titles and accounts wouldn't hurt and can make things easier later on if there are combined complications. However, the person's social security number serves as identification and proof of legal name change is fine.

There is no need to change your name on the titles at this time. When the time comes to transfer the title, you will have to have a Same Name Affidavit prepared and executed showing that both persons are one and the same. You should attach a copy of the court order changing the name as an exhibit for verification of the change. This should not affect the transfer at all.
