Legal Question in Wills and Trusts in Florida

Death Benefits

My father passed away three weeks ago. He left no will. His girlfriend of 18 years has locked away his property and requested from his place of employment all paperwork for his insurance and investments the day after his death. What do we three surviving children do to protect our dad's estate?

Re: Death Benefits

It is important to make sure he did not have a will.If not then he estate would pass under florida intestacy law-which could mean each of the surviving lineal descendants(you 3)could inherit his whole estate.(except

beneficiaries of life insurance, pensions, etc. I would suggest you call me at my office as soon as you get this response so I can get more specific facts about the estate.

Re: Death Benefits

Probably the best thing to do would be to petition the probate court for an intestate estate administration, name among the children a personal representative, who will then be in a position to marshall the assets, including property, paperwork, investments, etc.
