Legal Question in Wills and Trusts in Florida

I need information about probate. My uncle died 10 days ago and I am his only legal next of kin. He did not own much and has some debt. I was told his bank accounts must go into probate and I would need a lawyer to prove I was entitled. Is this the same case with a car he owned? Can I sell it if I have the title or will I get in trouble?

If he died 10 years ago, creditor claims would have expired. Also, by now those assets would be held in the Florida Unclaimed Funds Account.

To obtain your uncle's assets (bank accounts and car) you will need to file an Summary Administration (which is a simplified procedure for this type of occasion). You will also need a lawyer to handle.

Until you get the Order transferring those assets to your name, you will not be able to collect or sell those assets.
