Legal Question in Wills and Trusts in Florida

inheritance statute of limitations

Is there a statute of limitations on when a person can claim an inheritance against an estate?

We live in Florida but the individual died in Puerto Rico. Any assets to be claimed were also in Puerto Rico.

As part of the estate settlement process all assets should be distributed and any debts are suppose to be paid. Therefore, if you have a claim as a beneficiary you should get your share as well as a breakdown of the estate distribution. However,if you are owed money by the decedent you need to file a claim against the estate there are time limits. If you need help e-mail me your phone # and a good time to call you. " good luck".

There is no limit on when the probate can be initiated. But once probate is started, the limitations do apply.
