Legal Question in Wills and Trusts in Florida

My mother died in 2007, intestate. We are currently going through probation, and thankfully, almost everything has been deed to all of us. However, there is only one problem....she had a timeshare in Orlando, and none of us want it, it simply drains money out of our pockets, and is difficult to use with so many blackoutdates. My question is.......if we choose not to take over the mortgage on the timeshare, can they sue the estate for the remainder of the mortgage? Do we have to assume to mortgage because it was my mother's? If it goes into forclosure, how will that effect us? The 90 day period that creditors can make claims against my mother's estate has long since passed...........

If they were notified properly, their claim against the estate would be stale..
