Mothers death
my mom died and had a house. It is homesteaded. i have 2 brothers and a sister. we are all in agreement as to what to do with the house. sell it. she left a will with the same instuctions in it. sell it. divide equally. do we have to file her will? another expense.

yes , the will must be probated.

If you ever wish to sell the house, you will have to go through probate. That is the process to put on record the ownership passing from your mother to you and your siblings.
