Legal Question in Wills and Trusts in Florida

Power of Attorney

I am in Florida and have power of attorney for my father who is in an Alzheimers facility in Florida. I wish to give my son in Pennsylvania, power of attorney for myself. If I should die before my father, would my son's power of attorney roll over to my fathers assets and care as well?

Re: Power of Attorney

No. Not unless your father included your son as a successor agent in his DPOA. If your father is not incapacitated at the moment or comes out of his incapacity status, he can execute a new DPOA naming your son as the agent or alternative agent.
